Work Permit

To apply for a work permit in Thailand, you must either have an employer or a business here in Thailand (with your employer or your business needs registered capital of 2million baht or more). You will also need to get a non-immigrant B visa too. It is recommended you pay for a service to help you through this as it can be a long and grueling process. It can take up to 3 months in some cases for everything to be approved and issued a work permit.

To apply for the work permit, you will need to provide the following in english or Thai, if they are not, they may need to be translated:

 

Applicant documents

 

Your Passport with your non-immigrant B with copy of passport entry stamp and visa.

 

Six photo’s 4 x 6 cm’s.

 

Detailed description of the job you are applying for.

 

Your resume and details of your previous employment and education. (all degrees etc must be certified by your embassy or consulate)

 

A letter from your previous employer certifying your position, job description and period of employment. This letter must be signed by an authorized director. (must be certified by your embassy or consulate)

 

Medical certificate from any Thai hospital within 3 months and the check up must test insanity, leprosy, tuberculosis, elephantiasis, drug abuse, alcoholism and syphilis stage 3.

 

Letter of appointment.

 

Dependant (if any)

 

Passports of spouse and children with non-immigrant O visas and copies of visa and passports.

 

3 photos 4 x 6 cm’s

 

Existing work permits (if applicable)

 

Copy of Thai annual personal income tax returns (If applicable)

 

Original marriage certificate and birth certificate of children (must be certified by your embassy or consulate)

 

Employer’s Documents

 

A map of the company’s office in Thailand.

 

A chart showing the name and position of all employees.

 

5 photos that need to include the sign, environment and employees working.

 

Original company affidavit and company’s shareholders list, as issued by the Ministry of commerce within 6 months.

 

Copy of directors ID card and if the director is a foreigner, a copy of work permit is required.

 

Copy of added/business tax registration certificate

 

Copy of latest 3 months withholding personal income tax return (for all staff) and value added tax return. (must be certified by The Revenue Department and original receipt of payment)

 

Copy of latest 3 months distribution payment with the social security for all staff (must be certified by The Social Security Office and original receipt of payment)

 

Copy of annual corporate income tax return (must be certified by The Revenue Department with original receipt of payment of the latest year)

 

Copy of company’s certificate of incorporation.

 

Original latest year submission form of financial statement.

 

Original of the company’s financial statement of the latest 2 years (must be certified by The Ministry of Commerce or The Revenue Department)

 

After all documents are ready you will need to submit your application with documents at The Ministry of Labour

 

Once Work Permit approved

 

You must always have your work permit with you when working in business hours and must only be doing the work allowed on your work permit

 

Return your work permit within 7 days if you decide to resign.

 

Inform The Ministry of Labour of changes of name/address or if you have lost your permit.

 

If you want to extend your work permit, it must be done BEFORE it expires.
